The Demiris Law Firm, P.C. is thrilled to report another big win at trial in an elder law matter, involving an inheritance dispute, involving claims of financial elder abuse. The case also involved trust litigation and estate litigation where a trust was contested and the estate plan of an elder was contested.
The Demiris Law Firm, P.C. represented Respondent, Trustee, Leslie M. Byrne in a trial by Petitioner, Laurel Neth in Alameda County Superior Court (Case number RP 16814353).
In the lawsuit filed, Petitioner, Laurel Neth, sued to contest her step-mother's trust (alleging lack of mental capacity, undue influence and fraud). She also sued for financial elder abuse, Probate Code section 859 double damages, attorney's fees and costs, rescission, and other relief.
In the 14-page statement of decision, the Court denied all relief requested by the Petitioner in favor of the Respondent represented by the Demiris Law Firm. P.C. The trial lasted approximately 2-weeks and spanned nearly a calendar year.
